Terms of Service
Who runs Pendio
Pendio is run by Guglielmo Cecero, Switzerland. You can reach him at hello@pendio.app; the legal details are in the impressum. These terms cover your Pendio account and pendio.app; the app itself comes with Apple's licence (below).
What Pendio is, and isn't
Pendio reads your workouts and race courses and describes the ground: climbs and descents, grade-adjusted pace, training load, terrain, and race plans that share your own target time out over a course.
Pendio doesn't predict how fast you will be, coach you or tell you what to do. It isn't a medical device, and nothing in it is medical advice: talk to a doctor about anything medical. Its numbers come from models and from the files you give it, and they can be wrong.
In training, on a course and in a race, your safety is yours. Check the organiser's information, the weather and the trail yourself, and decide on the mountain, not from a number.
Your account
- An account is for one person. You sign in with an email code, Google, Apple or Strava.
- Keep your email address and the devices you sign in on secure. If you think someone else has signed in to your account, use “Sign out everywhere” and write to hello@pendio.app.
- You can delete your account at any time, in the app under Settings → Account → Delete account, or on pendio.app under Account → Delete account. This deletes everything Pendio's server keeps for your account, your race plan included, and ends Pendio's access at Strava and Apple. The privacy policy says what is deleted where.
- Deleting your account doesn't cancel a subscription bought through Apple: cancel it in your Apple Account's subscription settings.
Using Pendio fairly
Use Pendio for your own training and racing. Don't try to reach other people's accounts, overload or probe Pendio's server, get around its limits, copy or resell the service, or upload a file that isn't yours to use or that carries anything harmful. A course you add from a race page stays the organiser's: Pendio keeps your copy in your account for your own use. Pendio may suspend an account that breaks these rules, and says why at the account's email address where it has one.
Strava, Apple and Google
Strava, Apple (Apple Health, Sign in with Apple and the App Store) and Google (Sign in with Google) are separate companies with their own terms and privacy policies, which apply when you use them with Pendio. Pendio isn't affiliated with, endorsed or sponsored by any of them. Pendio works only as far as they let it: if one of them changes or stops what it offers, a part of Pendio may change or stop with it.
Free for good, and Pendio Plus
These parts of Pendio are free, for good: your workout sources and their sync, the workouts list and each workout's detail, All data, courses (importing them, Add to Pendio, the profile, the terrain and sections for your watch), Settings, and the plan of one race.
Pendio Plus adds plans, pace cards and fueling for every race, readiness against a course, the season, Trends and Climbs.
Nothing that is free is ever moved to Pendio Plus. A new part of Pendio is placed on one side or the other when it is built, and stays there.
No paid feature is on sale yet, so everything is included. The date paid features start is announced at least 30 days ahead, in the app and in the changelog.
If you joined before paid features start
Everyone who created an account before the date paid features start keeps the whole app, every race and all of Trends, free until 31 December 2027; from 2028 the founder's price is offered.
The race a free account includes
A free account includes the plan of one race: the course of your next A race; without one, of your next race; and with no race coming up, the course you added first. Once you use its plan, that race stays the included one. To move it to another race, write to hello@pendio.app: it can move once a year, and deleting its course doesn't free its place sooner.
Buying Pendio Plus
- Pendio Plus is bought only in the Pendio app on iPhone, through Apple's App Store. pendio.app never sells anything.
- Apple is the seller. The App Store shows the price for your country, taxes included, takes the payment and sends you the receipt.
- Pendio Plus is a subscription, yearly or monthly. It renews automatically until you cancel it in your Apple Account's subscription settings; cancel at least 24 hours before the current period ends to stop the next renewal.
- A one-time founder's purchase may be offered for a limited time.
- Refunds are handled by Apple: use Report a Problem at reportaproblem.apple.com.
- Pendio Plus belongs to the Pendio account you were signed in to when you bought it, and works wherever that account is signed in, in the app and on pendio.app. Restore Purchases in the app brings it back on another iPhone.
The app's licence
The Pendio app itself is licensed to you under Apple's standard licence agreement for apps (Apple's Licensed Application End User License Agreement). These terms cover your Pendio account and pendio.app.
Changes to these terms
If these terms change, the new version is posted on this page with a new “Last updated” date. A change that matters to you, such as what Pendio Plus includes or how it is sold, is announced at least 30 days before it applies, in the app and in the changelog, so you can delete your account before then if you don't agree.
Ending your account
You can end your account at any time by deleting it. Pendio may close an account that breaks these terms. If Pendio ever stops, it says so at least 30 days ahead where it can, in the app and on pendio.app; for a paid period that is still running, Apple handles refunds.
Liability
Pendio is offered as it is. As far as Swiss law allows, its operator isn't liable for damage from using Pendio or from relying on its numbers, in training, on a course or in a race. Liability for intent and gross negligence stays, as the law requires. The mandatory consumer law of the country you live in isn't affected.
Law and courts
These terms are under Swiss law. Disputes go to the courts at the operator's domicile in Switzerland. If you use Pendio as a consumer, you keep the right to go to the courts of your own country where its mandatory law gives you that right.
